In order to implement the requirements of the law of the people's Republic of China on the prevention and control of soil pollution, the measures for the management of special funds for soil pollution prevention and control and the notice on strengthening the management of ecological and environmental protection funds and promoting the establishment of project reserve system, strengthen the project management supported by the central special funds for soil pollution prevention and control, standardize the project management procedures and improve the use efficiency of funds, The relevant matters are hereby notified as follows:
1、 Project type and period
Soil pollution prevention and control projects, including soil pollution source prevention and control, soil pollution status investigation, soil pollution risk assessment, risk control and remediation scheme preparation, risk control, remediation, improvement of soil environmental supervision ability and other project types.
Project cycle refers to the process from budget release to project summary. The period of risk control and restoration projects generally does not exceed three years, the period of projects involving groundwater risk control and restoration and the safe utilization of agricultural land generally does not exceed five years, and the period of other projects generally does not exceed two years.
For projects with a long project cycle, funds can be arranged annually and in batches. When arranging financial support for the first time, the annual financial support plan shall be clarified, and funds shall be arranged preferentially in subsequent years. The annual budget of a project shall be reasonably arranged according to the estimated funds required for the project in the current year. The balance funds carried forward by the project shall be handled in accordance with the budget law of the people's Republic of China and the relevant provisions of the Ministry of Finance on carrying forward the balance funds.
2、 Project Management Division
(1) The Ministry of ecological environment, together with the Ministry of finance, is responsible for the construction, management and improvement of the project reserve system of the central special fund for soil pollution prevention and control, the preparation of project warehousing guidelines, the organization of local application projects, the evaluation and review of project warehousing, and the strengthening of project implementation supervision and guidance.
(2) The provincial competent department of ecological environment, together with the competent department of finance, shall be responsible for the construction of the provincial (District, city) special fund project reserve for soil pollution prevention and control, select the best to report the provincial (District, city) projects to the central reserve, review and verify the authenticity and accuracy of the project content, and strengthen the management, supervision and guidance of the project.
(3) The project unit is responsible for the preliminary work of the project, applying for inclusion in the reserve, organizing the project implementation and entrusting to carry out the effect evaluation. The project unit is responsible for the authenticity of the project proposal, feasibility study report, preliminary design, project implementation scheme and other documents; and is responsible for the application, progress and fund use of the project (settlement), quality, summary, filing, etc. the project unit shall be undertaken by the local people's government or its designated departments and units. In principle, the project approval unit and the project implementation scheme review unit shall not be regarded as the project unit.
3、 Project management procedure
Project management procedures include project application, evaluation and review of project warehousing, determination of annual support projects, organization and implementation and progress scheduling, project summary, reporting of project files, etc. The supervision, inspection and performance evaluation of the project shall be carried out in accordance with relevant regulations and requirements.
(1) Project application. The project unit shall prepare a project implementation plan and submit it to the relevant local competent department or the competent department of ecological environment in accordance with the relevant provisions of the province (district or city) to review the project implementation plan. The project feasibility study report and its reply can replace the project implementation plan and review opinions.
(2) Assess and review the warehousing of projects. The provincial competent departments of ecological environment and Finance shall be included in the project reserve of provincial special funds for soil pollution prevention and control according to the review opinions or project approval of the project implementation plan; combined with the needs of local soil pollution prevention and control, through the Central Ecological environment fund project management system (hereinafter referred to as the project management system) shall apply for projects to the central reserve. The Ministry of ecological environment shall organize experts in relevant fields to carry out evaluation and review, and incorporate qualified projects into the reserve in the project management system.
(3) Determine the annual support projects. According to the provincial central soil pollution prevention and control fund budget issued by the Ministry of finance, the provincial competent department of ecological environment shall, together with the competent department of finance, select the best projects from the central project reserve, and submit them to the Ministry of ecological environment and the Ministry of Finance for filing through the project management system.
(4) Organize the implementation and progress scheduling. The project unit shall organize the implementation in accordance with the approved preliminary design documents or project implementation plan to ensure the completion on schedule. The project implementation process shall be in strict accordance with the project implementation plan and relevant requirements, and the construction and other relevant records and relevant data shall be archived. The provincial competent department of ecological environment shall regularly schedule the project progress together with relevant departments, and report the progress of each project The project progress shall be reported to the ecological environment department through the project management system within 10 working days after the end of the quarter.
(5) Project summary. After the completion of the project, the project unit shall prepare a project summary report and submit it to the provincial competent department of ecological environment. The summary report shall review the implementation process of the project, evaluate whether the implementation content is consistent with the project reply document or project implementation plan, and whether the project has achieved the expected results. For the projects that should be subject to completion acceptance in accordance with relevant national regulations, the general manager shall The completion report shall be attached with the completion acceptance.
Before the project unit submits the summary report, the soil pollution investigation report, risk assessment report, effect assessment report, risk control and remediation plan involved in the implementation of the project shall be reviewed or filed in accordance with the law of the people's Republic of China on the prevention and control of soil pollution.
(6) Filing project archives. The project unit shall timely collect and sort out the documents and materials of all links of the project, establish and improve the project archives, and report the project archives to the provincial competent department of ecological environment at the same time as submitting the project summary report. If there are other provisions of the state, such provisions shall prevail.
4、 Project management requirements
(1) Project implementation plan, including project overview, necessity, project scope and content, technical route, investment estimation, funds invested in preliminary work, the amount of special funds to be applied for central soil pollution prevention and control (including annual fund support plan), implementation schedule, expected results, etc., so as to reach the depth of the feasibility study report. According to this province If the project implementation scheme is required to reach the preliminary design level according to the relevant provisions of (district and city), its provisions shall prevail.
(2) Bidding, procurement and financial examination. The project unit shall strictly implement the relevant national bidding and government procurement systems. The budget review shall be organized by the competent financial department. If there is no fixed standard in the budget review, the control price of bidding and procurement may be determined by means of price comparison and inquiry.
(3) Management system. For risk control and remediation projects, the project legal person system and project supervision system are implemented, and regions with conditions are encouraged to explore the whole process engineering consulting service and general contracting mode. Units engaged in soil pollution risk control and remediation activities and units or institutions participating in project construction and supervision shall obtain corresponding qualifications or have corresponding professional skills according to law power.
(4) Project adjustment. For a project whose technical route has changed significantly, or it is necessary to change the amount of special fund for central soil pollution prevention and control and the annual fund support plan, the project unit shall report to the project approval unit and the implementation scheme review unit for approval.
5、 Environmental supervision and management
(1) Environmental supervision. The competent department of ecological environment of the local people's Government shall supervise the pollution prevention and control in the process of project implementation according to law, and may carry out synchronous sampling inspection during effect evaluation.
(2) Credit management. The competent ecological and environmental departments of the people's governments at or above the provincial level and other departments responsible for the supervision and administration of the prevention and control of soil pollution shall comply with the law of the people's Republic of China on the prevention and control of soil pollution , relevant units and individuals' compliance with relevant laws, regulations and practices shall be recorded into the national soil environment information platform, incorporated into the credit system, credit records shall be established, illegal information shall be recorded in the social integrity archives, and incorporated into the national credit information sharing platform and the national enterprise credit information publicity system for public disclosure.
(3) Social supervision. Carry out soil pollution risk control and remediation activities. During the project construction, the project unit shall set up a bulletin board according to law to publish the project content, project objectives, construction plan, main soil pollutants, possible environmental risks and treatment measures, possible secondary pollution and prevention and control measures, relevant responsible persons of the project and contact numbers, etc Encourage the publicity of popular science knowledge related to soil pollution risk control and remediation. The signboard shall be eye-catching, which is conducive to the surrounding residents and people to know the information. It can be set at the intersection of the main entrance and exit roads in the project area. For projects close to or highly sensitive to sensitive points, the municipal competent department of ecological environment divided into districts may require the project unit to coordinate with relevant communities to establish a resident communication and coordination mechanism.
The local competent ecological and environmental departments at all levels shall, under the leadership of the local government, work with relevant departments to strengthen the organization and management of special funds for soil pollution prevention and control; Clarify the division of responsibilities for project management and compaction responsibilities; Relevant situations and existing problems during project implementation shall be reported to the local government in time.
Please report any major problems during the implementation of this notice to the Ministry of ecological environment and the Ministry of Finance in time.
The guidelines for the management of contaminated soil remediation projects on agricultural land (for Trial Implementation) (HB [2014] No. 93) shall be repealed at the same time.
